TERMS AND CONDITIONS

This contract is between

• Oliver Hall trading as Oliver Charles Photography

• You the Customer

Booking with Oliver Charles Photography confirms acceptance of the following:

ONE: Definitions

• Assignment

Your wedding booking and services as per your invoice

• Images

Digital photographs taken at your wedding

• Goods

Any physical products such as albums or prints

• Fees

The money you pay for services and goods

• Deposit

20 % booking fee to secure your date

TWO: Copyright and Usage

• Oliver Charles Photography owns the copyright in all Images

• You receive personal usage rights for printing and sharing with family and friends

• You must not sell images or use them commercially without written consent

• I may use selected images for promotional purposes with your prior consent

• I will not use any images of children under 18 without formal written consent

These might appear on my website portfolio social feeds brochures or competitions

THREE: Model Rights

• You confirm you have notified your venue and guests that photography will take place

• You indemnify me if any guest objects or makes a claim about being included in an Image

• You can withdraw promotional consent at any time by emailing me with the file numbers

FOUR: Consultation

• Consultations are usually phone or video call

• Meetings beyond 20 miles from KT22 Surrey may require travel costs

• Meetings normally take place Monday to Friday 9 to 5

FIVE: Delivery of Images

• Delivery is by online gallery

• I aim for four weeks from the wedding date

• This timeline is not guaranteed due to seasonal volume

SIX: Editing Scope

• Basic edit covers colour exposure contrast and basic tidying

• Retouching such as object removal or heavy beauty work is extra at £40 per hour

• I hold final creative discretion for which Images are delivered

SEVEN: Attendance and Replacement

• If I cannot attend due to illness accident or emergency I will try to provide a replacement photographer of similar style and skill

• If a replacement is not available my liability is limited to a full refund of sums paid

EIGHT: Exclusivity

• I am the only photographer providing stills on the day

• Guests may take photos for their own personal non commercial use

• Other commercial photographers or videographers shooting stills must not operate unless agreed in writing

• If this is breached I may stop coverage and no refund is payable

NINE: Timings and Co-operation

• You agree to set aside a 45 minute window between ceremony and wedding breakfast for group photos and couple photos

• You provide me with a hot meal at a reasonable time during the day. I do not require a seat in the main room and I prefer to eat elsewhere so I can rest and back up cards without distracting guests

• You help identify priority people or moments

• Results depend on a collaborative attitude

• Behaviour that risks safety or gear will end coverage with no refund

TEN: Limit of Liability

• No liability for indirect or consequential loss

• For total failure liability is capped at sums paid

• For partial loss of files a prorated refund applies based on delivered volume

ELEVEN: Force Majeure

• If government action disaster civil unrest strike or similar prevents delivery my liability will not exceed sums paid

• The deposit reflects intake admin time and is not refundable in this situation

• If work to date is greater than the deposit you pay the balance for work already delivered

TWELVE: Fees and Cancellation

• Deposit of 20% is due to secure your date

• Balance is due 30 days before the wedding

• Cancellation within 120 days of the date is chargeable at full package fee

• Pandemic or extreme events may allow a date move subject to availability and current pricing

• I always recommend you take out wedding insurance

• If invoices are late I may suspend services and charge £50 admin plus Late Payment of Commercial Debt Act interest

THIRTEEN: Termination

• If you breach these terms and fail to fix within 14 days I may end the contract

• Any sums already paid remain due

FOURTEEN: Entire Agreement

• This contract invoice and booking form form the entire agreement

• I may update terms for legal compliance or service updates

• The latest version is available on my website

PRIVACY NOTICE

This privacy notice covers www.olivercharles.photography

and complies with UK Data Protection Act and GDPR

Data Collection and Use

• I collect name email phone number and wedding details through the contact form

• These details are only used to respond to your enquiry

• Data is never shared with third parties

• Emails are stored in Gmail and subject to Googles privacy policy

Client Records

• Client data may be stored in email and secure documents

• Data is stored on password protected devices and encrypted external drives in my home office

• Data is used for communication and service delivery only

Client Galleries

• Galleries are hosted by Pixieset

• Password protected

• No personal data is needed to view a gallery

Guests Photographed at Events

• Weddings include identifiable people and this is covered by legitimate interests

• I do not use facial recognition

• Couples must notify guests that photography will take place

Promotional Use

• With your consent Images may be used for portfolio social platforms printed samples and awards

• You can withdraw consent any time by emailing the file numbers

Social Media Policy

• I will not request personal information through social platforms
